Kenneth survives attempted execution by lethal injection: death row inmate could be executed another way

Kenneth Smith, 58, was sentenced to death after being convicted of murder in 1996. Last November, he survived a first attempt at execution by lethal injection, after no vein could be found to insert the needle.
Last month, the U.S. state of Alabama petitioned the Supreme Court. Its aim was to approve the execution of Kenneth Smith by a new method: nitrogen asphyxiation.
According to the condemned man's lawyers, this is a violation of the US ban on "cruel and unusual punishment". It is also unconstitutional for them to attempt to execute a man for a second time.
